Welcome to Fay Furnishings. These Terms & Conditions govern the booking, design, and execution of interior design, homestaging, and custom furniture services offered by Megan (owner of Fay Furnishings).
1. Services & Initial Site Visit
Every interior project starts with an Initial Site Visit & Consultation. Booking this consultation is subject to the following:
- Consultation Fee: An initial consultation fee of R250 applies to local areas (Centurion, Irene, and Midstream). Outbound area fees are calculated based on travel distance.
- Securing Bookings: The site visit fee must be paid in advance to confirm your booking slot.
- Scope: The site visit allows us to discuss your ideas, lifestyle, layout needs, and to take measurements of the space. No digital design deliverables are provided during this initial visit.
2. Design Fee Proposals & Agreements
Following the site visit, a comprehensive design fee proposal quote will be compiled and sent to you alongside our contract agreement.
- Quotes are valid for 30 days from the date of issue.
- Creative design work (including space layouts, mood boards, and procurement curation) starts only after the contract is signed and the design fee deposit is received.
- Deposit Policy: A non-refundable deposit of 70% is due upon signing the Agreement before any design work commences. The remaining balance is billed according to the project-specific schedule.
- Revisions: The design fee includes 2 rounds of revisions. Additional revisions beyond this scope will be billed at an hourly rate of R450/hour.
3. Bespoke & Custom Furniture Procurement
We custom manufacture furniture pieces (e.g., custom sofas, occasional chairs, dining tables) exclusively for our Design Conceptualisation clients.
- Items billed on behalf of the client for procurement are subject to a 15% markup. Full payment for these items is required upfront before orders are placed.
- Once production of custom manufactured furniture pieces starts, procurement deposits are strictly non-refundable due to the custom nature of the items.
- We are not responsible for manufacturer delays, shipping damages, or third-party stock unavailability. Delivery dates are estimates only.
- Cancellation: Once a quote is approved and order placement is required, the client has exactly 24 hours to request a cancellation.
4. Website Images & Photography Copyright
All materials published on this website, including but not limited to text, layouts, brand elements, graphics, and specifically **all portfolio images, project photographs, styling setups, and before-and-after photos**, are the sole intellectual property of Fay Furnishings and are protected under copyright laws.
- No Unauthorized Use: These images and website materials may not be copied, reproduced, downloaded, cropped, shared, republished, or redistributed in any format or platform without the prior written consent of Fay Furnishings.
- Project Photography: Fay Furnishings reserves the right to take photographs of all projects throughout all stages (before, during, and after completion) and use them for business purposes, including portfolios, website, and social media. Client privacy is strictly respected, and names and addresses will remain confidential.
5. Intellectual Property & Design Concepts
All drawings, designs, custom mood boards, 2D floor plans, spatial layouts, and other conceptual drawings prepared by Fay Furnishings under any agreement remain the sole intellectual property of Fay Furnishings.
- These documents are provided to the client for their personal use on that specific project only.
- They may not be reproduced, copied, shared with third-party designers, or used for the execution of the project if the client terminates the design agreement prior to project completion or full payment.
6. Limitation of Liability
Fay Furnishings works with trusted independent contractors, builders, and fabricators. While we manage the styling, procurement, and coordination, we cannot be held liable for structural defects, installation issues, delays, or damages caused directly by third-party contractors or suppliers.
7. Governing Law
These terms are governed by and construed in accordance with the laws of the Republic of South Africa.
